These In-app Currency Terms (these “In-app Currency Terms”)
establish the terms and conditions between a customer (the “User”)
who uses the “REALITY” live video viewing application (includes
services ancillary to this application; the “Company App”)
provided by REALITY, Inc. (the “Company”) and the Company
regarding the acquisition and use of “Coins,” a virtual currency
that can be used within the Company App (“In-app Currency”).
These In-app Currency Terms may be amended at Company’s
convenience. When Company amends these In-app Currency Terms.,
Company will notify Member in advance of the amendment of these
In-app Currency Terms, the content of the amendment, and the
effective date of the amendment of these In-app Currency Terms by
notification in this App or other appropriate method determined by
Company. If the Member uses this App after the effective date of
the amendment, the Member will be deemed to have agreed to the
amended In-app Currency Terms, and the Member will thereafter be
subject to the amended In-app Currency Terms. The Company may
discontinue the provision of all or some of the In-app Currency
due to reasons such as the amendment or repeal of a law or
regulation or a change in social conditions. In such a case, the
type of In-app Currency that will no longer be provided and the
refund method will be announced on the Company App.
When acquiring and using In-app Currency, the User shall comply
with these In-app Currency Terms, the Membership Terms, the
Privacy Policy, and other terms established by the Company
(collectively, the “REALITY Terms”). In the event of any
discrepancy between the provisions of these In-app Currency Terms
and the other REALITY Terms regarding the acquisition and use of
In-app Currency, these In-app Currency Terms shall prevail.
If the User registers as a member through a third-party linking
service method, the Company will set up one (1) account for the
User for each SNS account (limited to a X account, LINE ID, Google
account, Facebook ID, or Apple ID; same applies below in these
In-app Currency Terms) that is held by the User and has already
been linked and for a single Company App. If the User registers as
a member through the guest user registration method, the User will
agree to “create a new account” and one (1) account will be
provided for each App. If the User registers as a member through a
third-party linking service method, even when using a different
device (but, with respect to mobile devices, limited to mobile
devices that can use the “iOS” OS provided by Apple Inc. or the
“Android” OS provided by Google LLC; “Device”), the same account
will be set up if it is linked with the same SNS account. If the
User registers as a member through a third-party linking service
method, the Company will issue an account to the User when the
User installs the Company App from the App Store service provided
by Apple Inc. (the “App Store”) or the Google Play service
provided by Google LLC and the linking with an SNS account is
first completed. Even if the Company App is reinstalled, the same
account will be set up if it is linked with the same SNS account.
The Company will manage the User’s acquisition or use of In-app
Currency for each account. In-app Currency may only be used by the
actual User who holds an account and shall not be transferred or
assigned to a third party other than the User, exchanged for cash
or other currency (including prepaid payment methods and other
virtual currencies issued by a third party), or loaned to a third
party other than the User, and the User shall not permit a third
party to use the In-app Currency. The User will manage the account
at his or her own responsibility and must ensure that third
parties cannot access or use the account. The Company may also
restrict the quantity of In-app Currency that the User can acquire
at one time or hold in an account.
Even if the User acquires or holds multiple accounts, In-app
Currency generally cannot be transferred between accounts.
(1) Free In-app Currency
The Company may issue In-app Currency to the User for free through
the method specified by the Company (In-app Currency issued for
free shall be referred to as “Free In-app Currency”). With regard
to Free In-app Currency, the qualifications for receiving the
currency, the quantity of the currency to be issued, the acts for
which the currency will be issued, and other issuance terms shall
be as separately established by the Company. No refund will be
provided for Free In-app Currency, even in cases where the Company
has discontinued the provision of all or some of the In-app
Currency.
(2) Paid In-app Currency
The User may purchase In-app Currency by paying the amount
displayed on the screen of the Company App (In-app Currency
purchased for a fee shall be referred to as “Paid In-app
Currency”).
The amount required for each purchase of Paid In-app Currency will be displayed on the final purchase confirmation page displayed on the payment screen of the Company App on the Device (including cases where it is a screen displayed by Apple Inc. or Google LLC or other payment service providers). The price of Paid In-app Currency may change due to fluctuation in the exchange rate and other factors.
The User may settle a payment for In-app Currency via Google Pay,
Apple Pay, credit card or the like through the Google Wallet
electronic payment system (“Google Wallet”) provided by Google
Payment Corporation or Google Payment Limited or the App Store, or
other payment service providers (payment processing companies that
make payments via Google Pay, Apple Pay, credit card or the like
shall be collectively referred to as “Outside Payment Vendor(s)”),
provided that, depending on the Device that is used, there may be
cases where some payment methods cannot be used.
The Company shall not be liable for the selection and use of a
payment method by the User. Any dispute regarding the payment
method shall be resolved directly between Google Payment
Corporation, Google Payment Limited, Apple Inc., or the Outside
Payment Vendor and the User.
The purchase of Paid In-app Currency will be completed when the
User clicks the purchase button on the final confirmation page for
purchasing Paid In-app Currency, when the User approves the
payment on the dialog displayed on the User’s device or when the
User clicks the payment page after entering credit card
information. Unless provided for in these In-app Currency Terms,
after the completion of purchase, the purchase price of the Paid
In-app Currency will not be refunded. The Company will issue Paid
In-app Currency promptly after confirming the completion of the
purchase of Paid In-app Currency by the User, but the issuance of
Paid In-app Currency may be delayed in some cases due to the
system and other reasons.
The User will be responsible for all consumption taxes and other taxes and charges that apply to the License (as defined in Section 3.1) of In-app Currency and digital content on the Company App (including acts that change the parameter or the like or produce other effects directly on the App without the use of digital content; “Digital Item(s)”).
In cases where the Company App cannot be used through no fault of
the Company, the User will remain obligated to pay the purchase
price of the Paid In-app Currency under these In-app Currency
Terms.
The purchase of Paid In-app Currency and the use of Digital Items
obtained with In-app Currency will incur communication fees in
addition to the purchase price of the Paid In-app Currency.
If a minor will be purchasing Paid In-app Currency, please be sure
to obtain the prior consent of a guardian or a person with
parental authority.
The acquisition or use of In-app Currency may be suspended in some
cases if the Company determines that it is necessary due to a
system failure or for system maintenance inspection or other
security management.
The only prepaid payment instrument that will be issued by the
Company on the Company App is the Paid In-app Currency described
in the “Payment Services Act Notices,” and the items and other
content that will be provided to the User within the Company App
will be deemed to have been provided when acquired by the User and
does not constitute a prepaid payment instrument.
By exchanging (using) In-app Currency in a certain account through
the method and within the scope specified by the Company, the User
may obtain a non-exclusive, non-sublicensable, and
non-transferable license to use Digital Items in such account
(“License”). The Digital Items covered by a License, the number of
In-app Currency required for such License, and any other terms
regarding the use of In-app Currency will be determined
individually for each Digital Item and either displayed on the
Company’s website or the Company’s App screen.
The In-app Currency with the earliest expiration date will be used
first. If no expiration date is specified, In-app Currency will be
used in the order issued. In such event, if the Paid In-app
Currency and the Free In-app Currency were issued at the same
time, the Free In-app Currency will be used after the Paid In-app
Currency has been used. The User may check the balance of the
In-app Currency in his or her possession through the procedure
prescribed by the Company. If the User finds an error in the
balance, he or she shall promptly notify the Company
accordingly.
Unless prohibited by law or regulation, the Company may place
restrictions on the quantity of In-app Currency that can be
exchanged for Digital Items within a certain period of time and
other uses of In-app Currency.
Even if terms such as “acquisition,” “purchase,” “buyback,” “sale,” or “order” are used in explanations relating to In-app Currency and Digital Items, the User will merely acquire Licenses in the In-app Currency and Digital Items and will not acquire any ownership or other rights. Ownership and all other rights in the In-app Currency and the Digital Items built into the Company App will be retained by the Company. The use of In-app Currency and Digital Items by the User will be limited to non-commercial, private use.
Unless otherwise provided, there is no restriction on the period during which the Paid In-app Currency can be used. Free In-app Currency may have an expiration date where it can only be used for a certain period of time from the issuance date of the In-app Currency (when the acquisition of Free In-app Currency is recorded in the User’s account). With regard to Free In-app Currency, please check the expiration date in the notices and the like at the time the currency is acquired.
Persons other than the User who acquired In-app Currency cannot use such In-app Currency. In-app Currency cannot be exchanged for anything other than the Digital Items designated by the Company. The Company may modify or alter the Digital Items at any time. Unless otherwise provided by law or regulation, the User is prohibited from exchanging any License in Digital Items with a third party for money or anything with monetary value and anything that constitutes an economic benefit and obtaining financial and/or economic benefit by lending, pledging or otherwise of In-app currency.
Unless it is required by law or regulation or the Company determines that it is absolutely necessary, no refund or reissuance will be provided for In-app Currency. If the Company is unable to confirm that the User requesting a refund or reissuance is the rightful holder of In-app Currency, the Company may refuse to provide a refund or reissuance. The sale or assignment of In-app Currency, exchange of In-app Currency for cash, creation of a security interest in In-app Currency, lending, pledging, and the sharing of In-app Currency with a third party are prohibited.
The User shall not commit any act that infringes, or may infringe, the rights of the Company, Apple Inc., Google LLC, Outside Payment Vendor, or any other third party or that interferes, or may interfere, with the Company App or the Company’s operation.
If the User does not pay the purchase price of Paid In-app Currency or violates the REALITY Terms, the Company determines that there is suspected fraud or improper or illegal activities in connection with the User’s account, In-app Currency, or Digital Items, or there is any other good cause, the Company may immediately take the following actions without notifying the User:
Please note that, if the User receives a suspension of use or cancellation of his or her account under this Section, the User will not be able to acquire or use any In-app Currency and the purchase price of the In-app Currency in his or her possession will not be refunded.
If the User causes his or her account to become invalid (e.g., voluntarily closes the account), even if there is a balance of In-app Currency in the account, such balance will expire. In such a case, no termination or refund regarding the In-app Currency will be granted.
When acquiring In-app Currency, if an error occurs with regard to the price, explanation, order confirmation, order processing, issuance, or any other matter, the Company will fix such error and, if necessary, may fix the quantity of the acquired In-app Currency (including charging the correct price) accordingly or cancel the acquisition of the In-app Currency.
If you are using a carrier payment with a usage limit, the carrier’s usage limit will apply.
Except in cases where the Company is at fault, the Company or its officers, employees, or agents shall not be liable for any direct damages arising from or in connection with the acquisition, use, or inability to use In-app Currency. In no event shall the Company be liable, under any theory, for special, indirect, consequential, or other damages (including but not limited to lost profits and loss of data), and the Company’s liability shall not exceed the amount that the User has paid to the Company as consideration for Paid In-app Currency.
