REALITY CON 2023 in NYC 
Attendance and Participation Agreement
This Attendance and Participation Agreement (“Agreement”) governs your attendance at and/or participation in REALITY CON 2023 (the “Event”) sponsored by REALITY, Inc. (“REALITY” or the “Company”). The Event is currently scheduled for November 18, 2023 in New York, New York, at a venue to be determined.
By registering for the Event, you are agreeing to this Agreement, which forms a legal contract between REALITY and the registered attendee and/or participant (“you”). If you are registering on behalf of another person, it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.
1. Event Admission and Participation.
1.1 Eligibility. You must be 21 years of age or older at the time of application and participation to attend or participate in the Event. Employees of the Company, their family members, and affiliated individuals are not eligible to participate.
1.2 Validation. On the day of the Event, you must present the "Entrance Code" sent to you within the REALITY app at the reception desk. The right to attend or participate in the Event is specific to you as an individual only; you are not permitted to give, resell, or otherwise transfer such right to any other person or entity. The Entrance Code is valid for one person only and can be used only on the specified date and time. Please note that the Entrance Code will not be reissued under any circumstances (loss, damage, deletion, etc.). Therefore, please ensure that you keep it secure. If it is discovered that someone other than you is attending or participating in the Event using your Entrance Code or other credentials, the right to participate will be invalidated. If it is determined by the Company that you have violated the terms of use of REALITY or of this Agreement, your right to attend and/or participate in the Event may be immediately revoked.
1.3 Verification. The Company may conduct identity verification and age verification at the reception on the day of the Event. Please be aware that you will be required to present a valid identification document that confirms both your age and identity. The original version of one of the following (not a copy) is required:
Driver’s License / Passport / Employee ID card (with a photograph) / Student ID card (with a photograph) / State ID Card / Residence Card (with a photograph) / Credit card with a photograph / Residence Card (Foreign Resident Registration Certificate)
If you do not have any of the above-mentioned identification documents, please bring originals (not copies) of two of the following:
Health Insurance Card / Residence Card without a photograph / Employee ID card without a photograph / Student ID card without a photograph / Credit card / Cash card / Notification card
1.4 Transportation and Admission. Please use public transportation such as trains or buses when attending the Event. Please note that you will be responsible for your transportation expenses to the Venue. Depending on congestion, there may be instances where you will have to wait for a significant period of time before entering, which may include queuing up outdoors. Please refrain from meeting or gathering with others after joining the queue, as it may inconvenience others. You are not permitted to queue up or otherwise attempt to secure your spot in line before __ a.m. on the day of the Event. The Event will be an all-standing format. You may be refused entry for any lawful reason, including but not limited to you displaying signs of contagious illness.
1.5 The Venue. There is no cloakroom or baggage storage service available at the Event venue (the “Venue”), so please refrain from bringing large baggage with you. Please ensure that you personally manage your belongings and valuables. The Company does not have any responsibility for any theft or loss that may occur. Please note that there are no dedicated spaces such as dressing rooms for changing clothes. You are required to follow the instructions of the Event staff inside the Venue. For safety reasons, the Event staff may conduct bag inspections as necessary. If the Event staff determines that your actions are obstructing the progress of the Event, you may be asked to leave the Venue.
1.6 Photography and Recording. At the Venue, there may be occasions where the Event staff or various media personnel request you participate in photography or video or audio recording. By attending the Event you acknowledge and hereby grant to the Company the right at the Event to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to the Company includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media. For purposes of example only, photographs and videos taken at the Event may be published on the Company's website, magazines, or various media outlets. You must follow the instructions of the Event staff regarding your photography, audio recording, video recording, and information dissemination within the Venue. You are permitted to photograph, film, or otherwise record only in areas where such activities are expressly permitted, and only with the prior written consent of the individuals appearing in the recording.
1.7. Other Restrictions. The following is prohibited at the Venue and during the Event:
● Unauthorized photography or recording during the performance by individuals other than the designated staff of the Company.
● Consumption of alcohol or smoking inside the Venue.
● Engaging in activities that disrupt public order, such as gambling, or behaving in a manner that causes inconvenience to other individuals.
● Bringing in food and beverages (including alcohol) other than covered drinks.
● Bringing in dangerous items (fuels, explosives, chemicals, fireworks, knives, etc.).
● Bringing in dogs, cats, small birds, other pets, or livestock (excluding service animals).
● Bringing in unmanned aerial vehicles such as drones.
● Bringing in items that generate excessive noise and may disturb other customers.
● Bringing in items that may soil or dirty the Venue or facilities.
● Bringing in items that emit unpleasant odors.
● Bringing in items that Event staff deems to be dangerous.
2. The Event
2.1 The content of the Event will be as determined by the Company. You acknowledge and agree that the Company, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, and time. The Venue is also subject to change in the Company’s sole discretion.
2.2 The Event may involve intense lighting and other visual effects. If you have a chronic illness, medical condition, or are pregnant, please participate at your own discretion and judgment. Please note that any internet connection fees or data charges you incur during the Event will be your responsibility.
2.3 The Company kindly requests that if you are not in good health, you refrain from attending the Event. If you feel unwell inside the Venue, please do not hesitate to inform the Event staff promptly and refrain from any strenuous activity.
2.4 To avoid congestion after the Event, controlled exit procedures will be implemented. You must follow all Event staff's instructions, including with respect to the exit procedures. Waiting for performers to enter or exit, prolonged stay around the Venue after the Event, or loitering in the vicinity of the Venue for an extended period of time is strictly prohibited.
2.5 Resale of tickets or other admission credentials for the Event on the internet, auctions, or any other platforms is strictly prohibited. The Company may refuse entry to those who have purchased tickets through the internet, auctions, or similar platforms. Additionally, the Company cannot assume any responsibility for any issues or disputes associated with any such resale or transfer.
2.6 The Company will kindly decline any gifts or letters intended for the performers. The Company is unable to accept or deliver telegrams, postal mail, courier packages, or any other forms of correspondence. We appreciate your understanding in this matter.
3. Force Majeure. In the event that the Event is canceled due to unavoidable circumstances such as inclement weather or disasters, announcements will be made on the dedicated website and within the REALITY app. Please check the web page for the Event or the REALITY app for updates.
4. Privacy Policy. Any personal information collected during the operation of this Event may be used for the purpose of event management, communication related to the Event, and responding to inquiries. For further information regarding the handling of personal information, please refer to the Company’s Privacy Policy located at https://reality.inc/privacypolicy/.
5. Intellectual Property
5.1 All intellectual property rights in and to the Event, the Event content and all materials distributed at or in connection with the Event (collectively, the “Event Materials”) are owned by REALITY and/or the Event sponsors or speakers presenting at the Event. You are not permitted to use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event or in any Event Materials distributed at or in connection with the Event for any reason without the prior written permission of the Company.
5.2. For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any rights, title, or interest in any of the Event Materials, or to any trademarks or other intellectual property rights owned or used under license by REALITY or any of its affiliates, or to grant to you any license to any intellectual property rights of REALITY or its affiliates, all of which shall at all times remain the exclusive property of REALITY and its affiliates.
6. Disclaimer of Warranties. The Company gives no warranties in respect of any aspect of the Event or any Event Materials and, to the fullest extent possible under law, disclaims all implied and statutory warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither Team Flower nor its affiliates can accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.
7. Limitation of Liability
7.1 Neither REALITY nor its affiliates shall be liable for any indirect, special, incidental, or consequential costs, damages or losses arising from or related to the Event or this Agreement.
7.2 The maximum aggregate liability of REALITY for any claim in any way connected with the Event or this Agreement whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to US$100.
8. Governing Law, Jurisdiction, and Venue. This Agreement shall be governed by the laws of the State of California, without reference to conflict of laws principles. The parties shall submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California and the parties agree that venue is proper in such courts.
